- A Rear End crash is when the front of one car crashes into the back of another car.
- Rear end crashes are one of the most common types of motor vehicle accidents accounting for 28% of all automobile accidents.
- Rear End crashes are usually caused by:
- Following too closely (“tailgating”)
- Speeding
- Talking on the phone or texting
- Drunk or Impaired Driving
- Inattentiveness
- Rain or Snow causing difficulty with visibility
A Rear End collision causes your body to violently fly forward and then snaps you back against your seat.
COMMON INJURIES INCLUDE:
- Brain injury or concussion due to your brain striking the inside of your skull as a result of the crash
- The discs between the vertebrae in your neck and spine may rupture and herniate causing neck and/or back pain requiring medical treatment and possibly surgery
- Damage to your spinal cord resulting in paralysis
- Broken bones
- Whiplash injuries due to the muscles and ligaments in your neck being stretched beyond their normal limits
- Sciatica (pain radiating from your lower back down the back of your legs)
The New York State Vehicle and Traffic Law greatly favor victims who were rear-ended by imposing “negligence as a matter of law” against the negligent driver who rear ended your car.
Despite this presumption of negligence, the Insurance Company for the negligent driver that rear ended you will still try to avoid compensating you by claiming that:
- You stopped short (even though you did not)
- There was ice on the road
- Their insured’s brakes failed
- You were not wearing a seatbelt
- You are not as hurt as you claim
- Offering you far less than your injury is worth
