Medical Malpractice is when the negligence of a doctor, nurse, or health care provider causes injury or death to a patient.

HOW OFTEN DOES MEDICAL MALPRACTICE HAPPEN

  • More medical malpractice cases are brought in New York than in any other state.
  • Medical Malpractice causes over 400,000 deaths per year which is more than people who die of respiratory disease.
  • 2% of doctors are responsible for 50% of paid medical malpractice claims.
  • Despite how frequently malpractice occurs, only 3%-5% of medical malpractice is reported.

HOW DOES A PATIENT PROVE A MEDICAL MALPRACTICE CASE

To prove medical malpractice the Plaintiff must show that the doctor or health care provider:

  • Departed from good and accepted medical practice; and
  • The medical malpractice caused injury and/or death.

Many patients are not sure if they have a medical malpractice case because their health providers have not told them much information about what happened during treatment.  Unfortunately, communication between medical providers and patients can be very poor.  Oftentimes, patients only know that something very bad has happened to them or a loved one but they don’t know the reason why.

Even if you are not sure if you have a medical malpractice case, it is always better to speak with our experts at Lebson Tangredi to determine if there was medical negligence.  Lebson Tangredi has been representing Plaintiffs in medical malpractice cases for over 45 years.
